Frequently Asked Questions
A timeshare or camp resort project that is either located in Utah or offered or sold in Utah must be registered with the Utah Division of Real Estate prior to offering or selling any interest in the project.
The following transactions are exempt and are NOT required to be registered with the Utah Division of Real Estate: isolated transactions by an owner of an interest in a project, an offer or sale by a governmental entity, a bona fide pledge of interest in a project, and an offering of fewer than ten interests in a project.
How to Register a Project
To register a timeshare or camp resort project, submit to the Division:
- Completed and signed Application for Registration of Timeshare Development .
- Completed and signed Developer/Owner Consent to Service .
- Completed and signed Developer/Owner Resolution of the Board of Directors .
- Completed and signed Developer/Owner Principal Data Sheet .
- Current Developer/Owner Property Report .
- Financial statements of the project.
- Title report/opinion for the project less than 30 days old.
- Non-refundable fee of $500 for up to 100 interests, plus $3 for each interest over 100, up to a maximum of $2,500 for each application.
To amend a project registration:
A project registration may be amended at any time by submitting to the Division:
- Signed cover letter providing specific information amending the original registration.
- $200 non-refundable fee.
To register additional interest in a project already registered, submit to the Division:
- Completed and signed Application for Registration of Timeshare Development.
- Non-refundable fee of $200 plus $3 for each additional interest, up to a maximum of $1,250 for each application.
To obtain a temporary sales permit:
The Division may grant a temporary permit allowing the developer to begin a sales program while registration is in process. To obtain a temporary sales permit, submit to the Division:
- Signed cover letter requesting a temporary sales permit.
- Completed and signed Application for Registration of Timeshare Development .
- Documentation from a financial institution less than 30 days old verifying an independent escrow account into which all funds from sales are placed with instructions that funds will not be released until registration is complete.
- Non-refundable fee of $500 for up to 100 interests, plus $3 for each interest over 100, up to a maximum of $2,500 for each application.
- $100 non-refundable temporary permit fee.
How to Register a Sales Person
According to Utah law, all individuals who market, offer, or sale interests in a timeshare or camp resort project in the state of Utah must register as a timeshare salesperson with the Utah Division of Real Estate.
To register as a salesperson, submit to the Division:
- Completed and signed Timeshare/Camp Resort Salesperson Application .
- $100 non-refundable fee.
How to Renew a Project
Registrations are valid for one year and must be renewed no sooner than six weeks prior to and no later than the expiration date.
To renew a project registration, submit to the Division:
- Completed and signed Timeshare/Camp Resort/Owner Registrant’s Annual Report .
- Current Developer/Owner Property Report .
- $200 non-refundable fee.
To amend a project registration:

- Signed cover letter providing specific information amending the original registration.
- $200 non-refundable fee.
How to Renew a Sales Person Registration
Registrations are valid for two years and must be renewed no sooner than six weeks prior to and no later than the expiration date.
To renew a registration, submit to the Division:
- Completed and signed Timeshare Salesperson Application .
- $100 non-refundable fee.

How to Submit a Complaint
The Utah Division of Real Estate has regulatory jurisdiction over
- appraisers
- appraisal management companies
- residential mortgage lenders and brokers
- real estate brokers and agents
- salespeople for subdivisions, timeshares, and camp resorts
The Division’s jurisdiction over mortgage lenders is limited to the origination of residential, retail, first mortgages. Banks, credit unions, loan-servicing, and second mortgages are regulated by the Department of Financial Institutions.
The Division does not have jurisdiction over homeowner associations, providers of nightly lodging, landlord/tenant disputes, contract disputes, or monetary damages.
The Division uses complaints to regulate licensees and investigate unlicensed persons who are acting as licensees. It does not mediate or resolve professional or personal disputes. If you believe you have a legal claim for monetary damages, you should consult an attorney about pursuing a civil lawsuit.
