What are the pre-license education requirements?

Through December 31, 2009, to become a licensed Mortgage Officer, an individual must take 20 hours of approved education from a certified Mortgage Pre-license School. We are currently transitioning to the requirements mandated under the Secure and Fair Enforcement for Mortgage Licensing Act (SAFE Act), so beginning on January 1, 2010, the pre-licensing requirement will be 20 hours of pre-licensing approved by the Nationwide Mortgage Licensing System (NMLS) and 40 hours of Utah DRE-approved education to meet the pre-license requirement in Utah for a Mortgage Officer. Note:  The NMLS 20-hour pre-licensing requirement will satisfy the requirement in all states that you wish to obtain a license.  Only the 40-hour pre-licensing is applicable in Utah.

What are the continuing education requirements?

Currently, and through 2010, to renew a license on active status an individual must complete 14 hours of certified Mortgage Continuing Education Courses every renewal cycle, including 2 hours of ethics and 3 hours of federal/state mortgage lending laws. These hours can be approved through the Utah DRE or NMLS.  New licenses granted onf or after October 1, 2009, will be required to obtain 8 hours of continuing education (either NMLS- or Utah DRE-approved) in 2010.  Annually, thereafter, all licensees will be required to complete 8 hours of NMLS-approved CE including 3 hours of federal law and regulations, 2 hours of ehtics (fraud, consumer protection, and fair lending practies), 2 hours non-traditional mortgaes, and 1 hour elective.

Note: Through 2010, you may obtain credit for a non-certified course by submitting to the Division the Non-certified Continuing Education Credit Request.

Note: CE is not required if renewing as inactive during 2010, but changing to active status during 2010 will require proof of 14 hours of CE.  Begining in 2011, to mainatin an inactive status, you will be required to complete 8 hours of NMLS-approved CE each year. 

What continuing education courses have been certified by the Division?

The SAFE Act requires that NMLS review and approve all continuing education courses that are to be offered to state-licensed mortgage officers and that are intended to satisfy the 8 hours of annual continuing education.  Through 2010, while we are transitioning under the NMLS, you will still be able to fulfill your 14 hours of continung education by taking either Utah DRE-approved courses or courses approved by NMLS.  Click here for a list of certified "Live" Mortgage Continuing Education Courses or "Online" Mortgage Continuing Education Courses .

How do I certify a continuing education course?

If you are a course provider wishing to certify a continuing education course through the Utah DRE fron now though 2010, you must: 

  1. Read and be familiar with Administrative Rule R162-208 regarding continuing education.
  2. Submit to the Division:

Note: Applications must be submitted at least 30 days prior to the date of the first class. All CE courses aproved through the Division will have an expiration date of December 31, 2010.

As of January 2011, after we have transitioned under the SAFE Act, all continuing education courses must be reviewed and approved through NMLS.  To meet this mandate, those providers who desire to have their continuing education courses approved by NMLS, must first register and be granted approval to become an NMLS-Approved course provider.  On the NMLS Resource Center, there are guidelines on how to complete this process.

How do I become a certified continuing education instructor?

From now until January 1, 2011, to become a certified Mortgage Continuing Education Instructor through the Utah DRE, an individual must:

  1. Read and be familiar with Administrative Rule R162-208 regarding continuing education.
  2. Submit to the Division:

After December 31, 2010, to be come a certified instructor, you must first be affiliated with an NMLS-approved school or separately become an approved provider and meet the criteria as outlined by NMLS.  See "How do I certify a continuing education course?" above.

How do I certify a Pre-license School?

To certify a Mortgage Pre-license School an individual must:

  1. Read and be familiar with Administrative Rule R162-210 regarding pre-license education.
  2. Read and be familiar with the Mortgage Officer Pre-license Education Curriculum.
  3. Read and be familiar with the PLM Pre-license Education Curriculum.
  4. Submit to the Division:

To become a certified pre-licensing school to teach the 20 hours of NMLS required courses, you must be reviewed and approved through NMLS.  NMLS began accepting provider applications on June 22, 2009. Information regarding the requirements associated with how to become an approved course provider has been posted to the Course Provider area of the NMLS website and applicants are strongly urged to review this material prior to applying. 

How do I become a certified pre-license instructor?

To become a certified Mortgage Pre-license Instructor an individual must:

  1. Read and be familiar with Administrative Rule R162-210 regarding pre-license education.
  2. Read and be familiar with the Mortgage Officer Pre-license Education Curriculum.
  3. Read and be familiar with the PLM Pre-license Education Curriculum.
  4. Take and pass the exam for which you plan to teach (Mortgage Officer and/or Lending Manager).
  5. Submit to the Division:

Pre-licensing instructors for the NMLS 20 hour pre-licensing must be approved through the NMLS course provider process.  Detailed instructions for how to submit an application to become an approved course provider have been posted on the NMLS resource web site and are contained in a document entitled “USER Guide: NMLS Course Provider Application Process.” Course providers are strongly encouraged to read this document prior to filling out their application forms and submitting their application online.

How do I renew a certification?

Utah DRE certifications for pre-licensing are valid for a two-year period and renewal forms will be mailed out six weeks prior to the expiration date.

NMLS course provider certifications are valid for two years and NMLS courses are approved for one year.  The renewal process will be performed on NMLS.

How do I view certified continuing education courses I have taken?

To view your certified continuing education courses, an individual must create an account or log into the Real Estate License Management System and click on "View Completed CE Courses".

Beginning in 2010, licenses will be transitioning onto NMLS.  All CE courses will be “banked” onto NMLS and will become part of the permanent record of each individual loan originator.  You will be able to view your records at any time by logging onto your account in NMLS.
